We have reached out to the Data Inspection Board to more fully understand the nature of their concerns and confirmed that their analysis was based on a review of our contract with a customer and not any identified concerns with our actual policies or procedures when processing data on behalf of our customers. The Board also confirmed that their concerns related to the process that our customer, acting as a data controller, undertook in engaging Zendesk as a data processor -- not Zendesk's actual activities as a data processor.
We believe that our Terms of Service (www.zendesk.com/terms) and Privacy Policy (www.zendesk.com/privacy), which constitute our standard contract with our customers, sufficiently details our commitment and obligations with respect to data privacy. However, we do understand and appreciate that many customers in the European Union prefer even greater assurance and detail with respect to these commitments. Therefore, upon request, we will enter into an additional Data Protection Agreement which provides these detailed assurances. If this is something you would like to explore in connection with your account, please let us know and we can coordinate with our legal department to provide you with this agreement.
